METRC Support

Several states have mandated METRC as the state inventory tracking system. METRC is also used for state reporting. The most recent state to mandate the use of METRC is Oklahoma. Commercial licenses and dispensaries have until May 26 to make the transfer to METRC. Oklahoma will be using METRC for seed to sale tracking and state reporting. Dispensaries have until August 24, 2022 to sell or dispose of any product that do not have METRC tags. Test results must be entered into the METRC notes section for each batch that passes testing.

All commercial licensees must continue monthly reporting by using the OMMA Monthly Reporting Template for activity through May 31. The last template with activity through May 31 is due June 15.

Dispensaries, transporters and waste disposal facilities must continue using the OMMA Monthly Reporting Template for any untagged sales, transports and waste disposal through Aug. 24. METRC will meet the monthly reporting requirements and the template is no longer necessary for all tagged sales, transports and waste disposal after May 31.

New Jersey Recreational Marijuana

New Jersey approved recreational marijuana in 2020. However, the state has announced that the sale of recreational marijuana may begin on April 21, 2022. Currently, there are 7 alternative treatment centers who have approval to begin sales on this date. Of course, these 7 companies are currently operating as medical marijuana treatment centers. Of the 7 approved companies, there will be 13 dispensary locations offering product to consumers. It is at the dispensaries discretion as to when they will offer recreational cannabis to consumers. Although, at least 7 locations have stated they will begin sales on April 21, the day after the industries major holiday, 4/20.

Arizona Social Equity Award

At the time, the Arizona Department of Health Services had limited information on when the winners would be announced. At this time, the department has insight into the event.

The Arizona Social Equity Program will award 26 individuals licenses on Friday, April 8, 2022. The drawing will take place at the department, and will be available to live stream online. The drawing will take place at 1pm Arizona Standard Time, and will be available to view here: azdhs.gov/live.

An approval to operate (ATO) is just that, it grants the license holder the right to legally dispense marijuana to consumers and profit from the sale. In order to obtain an “ATO” a company must prove it is ready to comply with Arizona’s marijuana statutes and rules. Cannabis Cost of Goods Sold

Since the cannabis industry is so fresh, many aspiring marijuana business owners have no idea how to estimate projected budgets, never mind yields, and cost of goods sold. Nor are they able to estimate the amount of time it will take for the business to see green (or make a profit). The cost of goods sold is also important because it reduces the businesses taxable income.

We will be upfront, calculating and tracking cost of goods for cannabis is tricky businesses. Math is required to find the total cost, per plant or batch. Some are looking to calculate an average per plant, batch or harvest, per gram or pound produced. Some are looking for average costs per square foot.

With good accounting goals and practices, cannabis businesses can produce reasonable budgets, provide accurate financial statements and its businesses tax liability will decrease. What elements should be considered when calculating costs? Let’s break this question into sections below, because there is no simple answer.

COGS Categories

Whether you currently own (or plan to own) a cannabis cultivation, processing facility, or dispensary, you will be subject to 4 general business costs that will be directly associated with the goods you sell.

Materials and Consumables

The materials and consumables used differ by business types.

Cultivation

A cultivation will need to track the cost of soil and grow mediums. A cultivation will also need to track how much is spent on nutrients and Internal Pest Management (IPM) products . Additionally, a cultivation will consider the costs of any fans, lights, air stones, pumps, tubing, sheers, and light bulbs used in the process be considered a cost of goods sold. These items can be amortized, which is covered below.

Materials that can be amortized can be used overtime through multiple harvests. For these items, the total yearly cost is calculated based on the amount of time the item may be used for. The total price is divided by the lifetime the item is used for to give a yearly average cost. This yearly cost is then divided by the amount of harvests during the given year. This number will indicate how much each harvest cost. To go further, the harvest cost can be divided by the total number of plants or pounds, indicated a cost per plant or per pound.

Processing

Processing facilities will want to consider the cost of the consumable used for the extraction technique chosen. Such techniques may include butane, ethanol, or CO2. In addition, packaging and tools used in the process are considered cannabis cost of goods sold.

Dispensary

To conclude, marijuana dispensaries may have a slightly different array of materials and consumables that factor into the COGS. Things such as printer ink, labels, patient bags, general office supplies, and hardware are also considered costs of goods sold.

Water

Water is necessary for any business type. Cultivation and processing tend to consume more water than a dispensary. This is because water is used in the process of growing and making marijuana products. However, only a portion of the water bill is considered a cost of goods sold. To get an accurate cost per plant, square foot, harvest, or light, the following equation can be used:

Total Water Bill divided by the square foot of the facility. Then the square footage of the facility is multiplied by the square footage used in cultivation/production. These numbers are multiplied by each other to give the estimated cost of goods sold. Lets use round numbers as an example;

If a water bill is $100 for the month, and the facility is 1,000 square feet, of which 80% is dedicated to production, how much would be considered costs of goods sold? 100/1000(1000*.8)= $80. This equation can be used for a a yearly basis as well. By dividing the yearly amount by the amount of harvests to give an example of how much each harvest costs.

Electricity

Electricity is also necessary for all businesses, regardless of the industry. The same equation used for water can be used to calculate the amount of costs to allocate to the COGS account. A cultivation will likely have a higher electricity cost of goods sold than other business types given the amount of electricity used to keep lights and HVAC units constantly running. Labor

Labor is commonly considered overhead, but any labor directly associated with producing a product is considered a cost of goods sold. Accountants will most often keep labor classified into different categories. Most often this is to track the labor associated with the production of products, as opposed to the cost of overhead the company is spending. Many companies are opting into capital purchases such as large equipment. These investments can reduce labor over time, but require capital to obtain. However, a dispensary may not be able to utilize automation. This makes the dispensary license type the most costly when it comes to labor.

Property Cost

If you’re renting or leasing, some of the amount spent can be allocated to the costs of goods sold. To find the amount of rent that is a cost of goods sold, you can use the same equation explained for water. Because only a portion of the business is used for cultivation, processing, and dispensing, only a portion of rent is considered a COG. If the building and land is owned with a mortgage, the monthly mortgage amount paid (excluding taxes, escrow, and interest) is used as the bill amount.

Why It’s Important to Have a Seed to Sale Tracking System

We know we have said it before. Having a seed to sale tracking system is a crucial part of any cannabis operation. However, Nevada regulators have proven how important having a good system can be. According to MJ Biz Daily, a cannabis operator in Nevada currently has a suspended license to operate after failing to comply with state track and trace regulations. The adult use and medical cannabis cultivation and production licenses are all under suspension.

According to the source, two instances of product mistracing occurred. First, the facility contained untagged or mislabeled plants and packages of product that were not in the state traceability system, METRC. The source also states that product that previously failed testing somehow made it to retailers. Clearly, company SOP’s were not being followed.

The worst part of this situation is that the company cannot resume business until they submit a plan of correction to the state for approval. The problems addressed must be resolved, and regulators must verify the resolution in order to have the suspension lifted. Let’s remind ourselves that every day the business does not operate is a dollar (or more) waisted.

Now that we have illustrated the consequences of not tracking regulated product, we will emphasize the importance of seed to sale tracking. If the company above had a seed to sale software that integrated with METRC would they have had missing packages? If the seed to sale tracking system was intuitive for users, would the company’s employees have mislabeled plants? Unfortunately, we might never know the answers to these questions. However, a look into a new seed to sale tracking system (if they were using one) would be a strong recommendation.

New York Adult Use Marijuana

New York approved adult use marijuana in March 2021. Since then, the state has been actively working to implement regulations for business owners in the industry to follow. The New York Office Of Cannabis Management recently released the regulations for adult use establishments. The regulations define license types, purchase limits, age restrictions, consumer taxes, and additional information relevant to cannabis distributors.

New York License Types

New York has established 12 different license types related to the adult use marijuana industry. Such licenses include: cultivator and conditional use cultivators allowing this license type to grow recreational marijuana, nursery which produces clones and seeds, processor which allows the licensee to create extract products, distributor which sells cannabis wholesale, retail dispensary which sells to cannabis consumers, and a cooperative license type for vertically integrated companies. In addition to these primary license types, the state will approve ancillary business licenses. Such license types include specifically; onsite consumption, delivery, and microbusinesses.

Adult Use Sale Restrictions

The regulation of marijuana sales has defined purchase limitations for consumers. Consumers 21 and over may possess up to 3 ounces of cannabis flower, or 24 grams of concentrated cannabis. The sale of recreational cannabis to consumers younger than 21 years of age remains illegal.

New York Marijuana Tax

New York has 3 different tax types for the sale of recreational cannabis. There is currently a 4% local tax, a 9% state tax, as well as a tax that is calculated based on the milligrams of THC the consumer purchases. for example, edibles are taxed at $0.03 per milligram of THC in the product, concentrates are taxed at $0.008 per milligram of THC, and flower is taxed at $0.005 per milligram of THC.

To shed light on the amount of taxes consumers will pay, let’s look at a few examples. If a consumer purchases an edible product with 100mg THC, they will pay a $3.00 THC tax. Similarly, if a consumer purchases 1 gram of concentrate product testing at 70%, they will be subject to a $5.60 THC tax. Lastly, when a consumer purchases 1 gram of cannabis flower which tests at 20%, they will be subject to a $1.00 THC tax. The THC tax described above is in addition to the local and state taxes a consumer is subject to pay.

5 Ways to Reduce Operating Costs for Cannabis Cultivations

Let’s start with the basics. How are your light schedules staged? Do you use an environmental regulation system? Are you hand watering, or using an irrigation system? Have you purchasing product in bulk? Lastly, how are you tracking the costs of all this overhead and applying that cost on a “per item” basis? In short, are you using cost accounting in your business? If you’re wondering how these questions can help you reduce operating costs for cannabis cultivations, you’ll want to read more about each category below.

Lighting Schedule

Many growers are suggesting the switch from High Pressure Sodium lights to LED (Light-emitting diode) lights. This recommendation could be valuable if the grower is willing to make the switch, and the company is willing to invest the cash into new lighting altogether. We however, have a different alternative. If you have multiple rooms flowering (12-12 light schedule), stage each rooms light schedule. What we mean here is, have half of your room lights on while the other half is sleeping. Essentially, you would have lights on 24 hours a day but you will be drawing less power during these hours. This will help with the amount of power drawn at the time the lights turn on, and will reduce energy costs by running rooms during off peak hours. If you utilize this method, it is important to inspect all rooms to ensure no light leaks are visible. If you’re a grower, you’ll know what we mean.

Environmental Regulation System

Choosing the rights environmental regulation system is just as important what the plants are eating. Regulating the humidity, temperature, and VPD (Vapour-pressure deficit) can help promote photosynthesis in the cannabis plant according to the Frontiers in Plant Science article “Minimizing VPD Fluctuations Maintains Higher Stomatal Conductance and Photosynthesis”.

Fertigation Plan

If you are currently hand watering, you may consider installing a fertigation system to reduce labor costs. For instance, as your business grows, employees will spend more time watering plants. This time could be designated to crop work, or other growing duties. If you have an irrigation system currently installed, you may consider reclaiming your water. This will take investing in a water reclaim system however, the investment will pay off in no time. You will not only be saving water, you will also be appeasing public zoning boards such as the planning and zoning committee.

Bulk Purchasing

Let’s talk procurement. If you find yourself purchasing items at the last minute to keep operations going, there is definitely an issue. Consider purchasing items used in day to day operations in bulk so you don’t find yourself purchasing items from third party vendors who often inflate prices to make a quick buck. Soil, nutrients, packaging, and even office supplies such as paper and ink should be bought in bulk. Additionally, you should try to source these items directly from the vendors producing them. There are certain exceptions to this as some vendors will not do business with cannabis cultivations, but often times this will not be an issue. If you decide to purchase in bulk, you may also be eligible for a bulk discount, so don’t forget to ask your representative about those savings as well.

Forecasting

We have covered a lot about how to reduce costs in cannabis cultivations. Lighting schedules, VPD, and fertigation systems are all self explanatory to growers. You might still be wondering, well how do I know how much to purchase? What is considered “bulk”, or what if I over-purchase? Not to worry, we talk forecasting and tracking costs below.

Forecasting is important so you don’t over-purchase but also, you don’t under purchase which is how those last minute must haves lead to increased operating costs. You know how many plants go in each room, and how many times your room will turn in a year, so do some math and plan accordingly. Always remember to give yourself some slack when calculating these numbers. Soil will sometimes spill, or pots may come in cracked so you’ll want to account for those unforeseen instances. Forecasting packaging can be a bit more complicated. Utilizing previous data from room harvests is the best way to estimate the amount of finished product you may get. For ancillary products, utilizing sales data to forecast production needs is the best forecasting method for packaging. Think “How much do I need to make”, “How much have I previously sold”, and “How much do I expect to yield from this harvest?”.

Tracking

Tracking the data is the most important thing you can do with your cannabis business. Previous sales and harvest data can help any business owner make data driven decisions. These decisions can reduce operating costs for cannabis cultivations. You should also be tracking the costs of your operations. How are you tracking overhead and applying it to the plants that are alive? Are you considering your plants to be assets on your balance sheet? How is the value of each plant calculated? These are all questions your accountant could probably answer; right? Oklahoma To Stop Accepting Marijuana Licenses

Oklahoma has been an open market when it comes to the cannabis industry. Oklahoma rule currently has no cap on the number of marijuana licenses that can be approved. Specifically, there are currently over 8,000 cultivations, 1500 processors, and 2,000 dispensaries in the state of Oklahoma.

However, the Oklahoma Medical Marijuana Authority (OMMA) has been unable to sufficiently staff for the number of licenses they have approved. The OMMA is responsible for ensuring all licenses are in compliance with state regulations. However, the state agency but have failed to do so as it currently stands. For instance, 40% of licensed businesses have not been paying state taxes. This among other issues were identified by the legislative office’s report.

The cap on licenses would allow the OMMA to bring current licenses into compliance with state regulation. It is unclear as to when Oklahoma will stop accepting marijuana licenses. Virginia Senate Passes Recreational Marijuana Bill

Virginia passes a recreational marijuana bill that would allow current licensees to start adult use sales in September.

Previously, adult use sales would begin in 2024. However, the Virginia house of representatives must still pass the bill before recreational marijuana sales can occur.

Consequently, the state plans to charge a $6 million dollar fee for each marijuana processor, and a $500,000 fee for hemp processors planning on entering the market early. With these fees, the state will offer social equity operators benefits for establishing a license in the industry. For example, social equity applicants will have the opportunity to apply for a loan program. Specifically, the loan program will aid social equity applicants with licensing fees and operational funding to enter the market.

The Virginia Department of Health Professions will publish additional information on the recreational marijuana program as it becomes available.

Mississippi Medical Cannabis Legalization

As of Wednesday January 26th, 2022, Mississippi adopted a comprehensive medical marijuana program. After Governor Tate Reeves signed Senate Bill 2095 on Wednesday, it became law immediately. Therefore, Mississippi became the 38th state to accept medical cannabis legalization.

Under Senate Bill 2095, medical cannabis distribution licenses must be awarded to aide with expanding the market. The application acceptance process will begin in June of 2022. Before you apply, it would be helpful to review the requirements found at the Mississippi State Department of Health website. The department of health is responsible for licensing practitioners, cultivations, processing, testing, waste disposal, and transportation facilities. In contrast, the Mississippi Department of Revenue is responsible for licensing dispensaries.
