Recreational Marijuana in NV
As part of marijuana legalization, the state of Nevada is responsible for regulating businesses that participate in the marijuana industry. Only businesses licensed by the state specifically for marijuana operations are legally allowed to grow, manufacture, test, distribute, or sell marijuana in Nevada. Consumers may only legally buy retail marijuana from a state-licensed retail store.
On November 8, 2016, Nevada voters passed the Regulation and Taxation of Marijuana Act (Ballot Question 2). The Act legalized the purchase, possession, and consumption of recreational marijuana for adults 21 and older.
Medical Marijuana in NV
In 2000, Nevada voters approved medical marijuana by ballot initiative. The Medical Use of Marijuana Act NRS 453A.120 enabled the use of medical marijuana in Nevada in 2001. These laws allowed qualifying patients to apply for registry identification cards to use medical marijuana for certain chronic or debilitating conditions. In 2013, the Legislature approved Senate Bill 374 (Chapter 547, Statutes of Nevada), directing the Division of Public and Behavioral Health (DPBH), Department of Health and Human Services, to develop regulations and authorize licensed and registered establishments to produce, test, and dispense medical marijuana and marijuana-infused products. There may be a total of up to 66 licensed and regulated dispensaries in the state. Medical Patients will be taxed differently than adult use and will have access to higher dosed cannabis packages.
