The Recreational Market in Virginia
It will not be legal to sell recreational marijuana until January 1, 2024. The law enables the sale of recreational cannabis to adults 21 years of age and older. The law will require all Virginia recreational marijuana sales be recorded in a seed to sale software for regulation purposes. On January 1, 2024 legal sales to adults 21 and older will begin.
Who Oversees the Recreational Marijuana Program
The Cannabis Control Authority (CCA) was created on July 1st, 2021 to regulate the recreational marijuana industry in Virginia. This includes issuing licenses for businesses, creating health and safety guidelines, and promoting diversity within the industry. The CCA will not complete marijuana regulations or begin accepting applications for businesses until 2023.
Virginia Sales Restrictions
Virginia sales restrictions have been defined by the Cannabis Control Authority as the following:
- cannabis flower allows for up to 4 ounces per 30 days to be dispensed to a patient.
- Patients who purchase cannabis oil products are allowed a 90-day supply. Such products, as defined under the law, must contain per dose a minimum of 5 mg of CBD or THC-A and may contain up to 10 mg of THC. Products permitted under the law may be in any formulation, including inhalable, edible, and topical preparations.
- Possession of up to an ounce of marijuana is legal for people 21 and older. This began July 1, 2021. Adults caught with more than an ounce but less than a pound will face a $25 fine.
