On April 19, 2017, Senate Bill 386 was signed into law by Governor Jim Justice. Senate Bill 386 created the Medical Cannabis Act that allows for cannabis to be used for certified medical use by a West Virginia resident with a serious medical condition.
Who Oversees the West Virginia Medical Marijuana Program
The West Virginia Department of Health and Human Resources, Bureau for Public Health, Office of Medical Cannabis oversees the regulation of the medical marijuana industry. The Office of Medical Cannabis in West Virginia requires the use of a seed to sale software for the tracking of all medicated product. The law only allows the use and distribution of medical marijuana through specific forms.
West Virginia Medical Sale Restrictions
The regulation of marijuana sales has defined purchase limitations for consumers. A consumer has the following restrictions: the dispensary may not dispense an amount greater than a 30-day supply (indicated by prescription) until the patient has exhausted all but a seven-day supply provided pursuant to §16A-4-5 of the code.
