The California Medical Marijuana Market
On November 6, 1996, PROPOSITION 215 (also known as the California Compassionate Use Act), was enacted and effective by voters. The new code would become the California Health & Safety Code 11362.5 which would legalize medical marijuana in the State of California. Just before the ballot initiative Prop 64 passed in 2016, the LA Times offered an overview of the long and treacherous history of cannabis laws in California and predicted why this law will be different. While we still face many uncertainties the states current efforts to regulate and tax marijuana like alcohol demonstrates signs of government support for marijuana businesses.
Who Oversees the Medical Marijuana Industry in California?
The Department of Cannabis Control of California (DCC) was created on July 1, 2021. This agency will take place of the previous three overseeing agencies; CalCannabis, Manufactured Cannabis Safety Branch (MCSB), and The Bureau of Cannabis Control (BCC). DCC regulates the: growing of cannabis plants, the manufacturing of cannabis products, the transportation and tracking of cannabis goods throughout the state, the sale of cannabis goods, any events where cannabis is sold or used, and the labeling of goods sold at a retail level.

The regulation of marijuana sales has defined purchase limitations for medical patients. To explain, if a medicinal cannabis patient’s valid physician’s recommendation contains a different amount than the limits listed for Adult Use, the medicinal cannabis patient may purchase an amount of medicinal cannabis consistent with the patient’s needs as recommended by a physician and documented in the physician’s recommendation.
